Employment for indefinite period of time (Pogodba za nedoločen čas)

WHAT

The employment contract of indefinite duration is a contract where the employment termination date or contract termination date is not specified.

The contract must include the terms and conditions, rights, responsibilities, and obligations of both the employee and employer. It must also include the provision of work time which is agreed between the employer and employee. Work performed under this contract is either full-time or part-time. Full-time employment usually carries 40 hours per week but not less than 36 hours per week. Part-time employment consists of less than 36 hours per week. A part-time employee has the same rights and obligations as the full-time employee.

WHO

Any person of 15 years of age or older. The citizens of EU, EEA, and Switzerland have the same employment rights as Slovenian citizens.

Third-country nationals must have a valid single residence and work permit acquired before arriving in Slovenia or they must have the right to free access to the labor market. The citizens of Bosnia and Herzegovina and the citizens of Croatia must acquire a work permit.

HOW

Before you start working, your employer must arrange a medical examination with a physician who is an occupational medicine specialist in order to establish if you are physically capable of performing the work. The employer must present you with a draft of the employment contract three days before signing the contract in order to give you enough time to read the details of the contract.

GOOD TO KNOW

The contract must include the following information:

  • Information about the company and the employee (name and surname)
  • Job title and description of job tasks and responsibilities
  • Starting date of work
  • Location of work
  • Statement of contract duration: indefinite (in case of an employment contract of limited duration, the contract termination date must be specified)
  • Statement on whether the employment is full-time or part-time or shift work
  • Information on the salary and the date of its payment
  • Right to annual leave
  • Notice period in case of contract termination
  • Terms and conditions of collective agreements

ATTENTION

The employer must enter you into the compulsory insurance scheme on the day you start your employment.
